Terms and conditions of sale

The rules that apply to every order placed on this site: products, prices, payment, delivery, withdrawal, guarantees and disputes.

1. Purpose and acceptance

These terms govern distance sales of fine-food products concluded on this site between LA BOX GOURMANDE - ETS GIRARDI and its customers, whether private individuals or businesses.

Placing an order constitutes unreserved acceptance of these terms. The applicable version is the one published on this page on the day of the order.

Orders from companies, works councils and associations may be the subject of a specific quote. The terms of the accepted quote then take precedence over these conditions.

2. The seller

3. Products

The products sold are foodstuffs and fine-food items: chocolates, confectionery, Monegasque specialities, foie gras, sweet and savoury groceries, wines, as well as hampers and gift boxes made up from these products.

They are offered subject to available stock. The photographs illustrate the products without forming part of the contract: the vintage, size or presentation of a product may vary. If a product in a gift box is unavailable when the order is prepared, it is replaced by an equivalent product of the same price; the substitution is stated on the parcel.

The composition, list of ingredients, allergens, best-before date and storage conditions appear on the packaging of each product. This information is provided before ordering on simple request.

4. Sale of alcoholic drinks

The sale of alcoholic drinks to persons under eighteen years of age is prohibited. By confirming an order, the customer declares that they are at least eighteen years old.

Alcohol abuse is dangerous for your health. Drink in moderation.

5. Ordering

The customer selects their products, enters their delivery details and then confirms the order. Before confirmation, they can see the product details, the total price and the delivery charges, and can correct what they have entered.

The order is recorded as soon as it is confirmed, and acknowledged by email. The sale is formed when the seller accepts the order.

For an order intended as a gift, the customer states the recipient’s name, the delivery address, the message to be written on the card and the requested delivery date.

6. Prices

Prices are shown in euros, inclusive of all taxes. The tax applied is French value added tax, as the Principality of Monaco forms part of the French fiscal territory for this tax.

Delivery charges are added to the price of the products and shown before the order is confirmed. They are free for any delivery in Monaco. In metropolitan France, parcels are shipped by Colissimo at 8.95 €, free from 69 € of purchases. For another country or the overseas territories, the applicable La Poste rate is communicated and accepted by email before the order.

The preferential rates granted to companies, works councils and associations depend on the volume ordered and are set by quote.

7. Payment methods

Payment is made by one of the following methods:

  • Credit or debit card, through the bank’s secure payment gateway. Card details do not pass through the site and are not kept by the seller.
  • Cheque, made payable to LA BOX GOURMANDE - ETS GIRARDI.
  • Bank transfer, using the details provided with the invoice or on request.
  • Cash on delivery, for deliveries made by the seller.
  • Carlo, the Monegasque mobile payment app.

8. Payment for an order placed on the site

Online card payment is not yet active on this site. Once confirmed, the order is recorded and the seller contacts the customer to agree on payment by one of the methods above.

The products remain the property of the seller until the price has been paid in full. Risk passes to the customer on handover of the parcel.

An invoice is issued for every business order and, on request, for any order from a private individual.

9. Delivery

Orders are prepared in Monaco and dispatched within 48 working hours of their acceptance. They are delivered in Monaco and metropolitan France; no collection on site is offered.

Delivery to another country or the overseas territories is possible on request, at La Poste’s current rate, after written agreement on the price and lead time.

Delivery is made to the address given by the customer. An incomplete or inaccurate address remains the customer’s responsibility and may incur reshipping charges.

For an order intended as a gift, the requested delivery date is confirmed by the seller according to preparation constraints and the carrier.

10. Receipt and complaints

If a parcel is damaged, opened, incomplete or not received, contact the seller at [email protected] with any available photographs and order reference. The seller remains responsible for delivery until the parcel is handed to the consumer or a person designated by them.

You may also record reservations with La Poste and send it a claim, copying the seller. This does not condition your rights against the seller. The seller examines the claim and offers a replacement, a new delivery or a refund according to the applicable rights.

11. Right of withdrawal

Consumers have fourteen days from receipt of the goods to notify withdrawal without giving a reason. For an order delivered in several parts, the period starts upon receipt of the last item.

Only applicable statutory exceptions can exclude this right, including goods liable to deteriorate or expire rapidly and goods unsealed after delivery that cannot be returned for health protection or hygiene reasons. Being a food product does not by itself exclude withdrawal. Non-perishable products, wines and containers remain eligible unless a statutory exception applies to the particular item.

Withdrawal may be notified using the form below or any unambiguous written statement sent to [email protected] or 17 avenue de l'Annonciade, 98000 Monaco. The goods must then be returned within fourteen days of that notification. Return postage is paid by the customer. Protect the goods for transport.

The seller refunds the sums received, including the original standard delivery charges, within fourteen days of notification. The refund may be withheld until the goods are received or proof of dispatch is provided, whichever occurs first. The original payment method is used unless the consumer expressly agrees to a different method without fees.

12. Guarantees

For buyers resident in France, the seller remains bound by the legal guarantee of conformity provided for in articles L217-3 et seq. of the French Consumer Code and the guarantee against hidden defects provided for in articles 1641 et seq. of the French Civil Code.

For buyers resident in Monaco, the legal guarantees of Monegasque law apply.

As the goods are foodstuffs, the guarantee is assessed against the best-before or use-by date shown on the packaging and compliance with the stated storage conditions.

13. Liability and force majeure

The seller is responsible for proper performance of the order, including delivery entrusted to a carrier. Liability can only be excluded in the circumstances provided by law, including where the seller proves an act attributable to the consumer, an unforeseeable and unavoidable act of a third party to the contract, or force majeure.

Access to the website may be temporarily interrupted for maintenance. This does not reduce consumer rights in relation to an order already concluded.

14. Complaints and mediation

Any complaint is first addressed to the seller, by email or by telephone. The seller undertakes to reply and to seek an amicable solution.

15. Personal data

The data collected when an order is placed is necessary for its processing, delivery and invoicing. Its processing is described in the privacy policy.

16. Applicable law and jurisdiction

These terms are governed by Monegasque law.

Consumers retain the benefit of the mandatory protective provisions of the law of their habitual residence.

Failing an amicable resolution, the dispute falls under the jurisdiction of the courts of the Principality of Monaco, without prejudice to the mandatory jurisdiction rules applicable to consumers.
